The declaration of single status is actually a legal statement of an affiant that he or she is single or bachelor. This statement becomes important when you want to solemnise marriage abroad. However, there are a few countries that require it from their own citizens before they get all set for matrimony.

There are certain countries that don’t need it from their natives, but seek it from foreigners. This is purely a preventive measure to secure the rights of their own citizens. Polygamy or sham marriage, which refers to such people who entered into it without intending to live like a real life couple. Some people find it an easy way to get the PR of the foreign country effortlessly, which is absolutely a wrong practice. So, various countries have made it mandatory to present this document to their foreign ministry.

This document may be known with different names in various countries. These can be the following-Certificate of No Record

Certificate of No Impediment, Certificate of Nulla Osta, Single Statutory Declaration, Certificate of Legal Capacity to Contract Marriage and so on.

What is the Declaration of Single Status?

As aforesaid, the declaration of single status certificate a legal document. Most of the time, it is recognised as a sworn statement, which has the details of the affiant and his/her parents. You can understand it as a documented proof of your single status, which ensures that you can marry anywhere.

It’s noteworthy that the affiant can be a divorcee, separated individual, or a widowed person. This documented proof shows every detail about the previous marriage, which proves the legal capacity of the person to marry. If there is any dependent, it clearly tells about the same.

In essence, it empowers a person with the freedom to marry anywhere across the globe. But, getting this proof is not a cakewalk. You have to enclose certain proofs in support of your application. It’s verified, and then, attested upon verifying the details.

Checklist of Documents to Support the Declaration of Single Status Proof

Here is the list of all proofs. The bachelors need to show only identity based documents, whereas the other cases should provide some additional papers.

Bachelors

• An affidavit that reads the affiant is single and the given details (of address, identity and witnesses) are true.
• Address proof, like bank passbook, rental agreement, voter ID, nationality card etc.
• Passport or visa
• Birth proof, like birth certificate, NABC, school certificate.
• Parents’ identity proof, such as their voter ID, nationality card

Divorced/Widowed

All the aforementioned papers together with these docs will be required:

• Decree Absolute (if the applicant is legally divorced)
• Death certificate (if the applicant’s ex-spouse is no more)

How Can You Get It?

For this proof, you need to follow a few steps. If you’re abroad and cannot visit your native country, follow these steps:

• Visit your country’s embassy website.
• Raise a request for the Declaration of Single Status.
• Schedule an appointment.
• Visit the consul as per schedule.
• Get your documents attested, and the verification will take place in the backend.

Other Way

There is another way to get it. You may physically visit the court where you come from (back in your country). Alternatively, you may visit an A-gazette officer and request for an affidavit. He/she will draft the document and attest to it.

Later on, you should hire a consultant, as S2NRI, for getting it attested from the ministry of external affairs. Once done, it would pass it over to you. You may show it in the embassy and get it legalised there also.

How Many Days Does It Take to Get It?

It may take 15 days to a month if your paperwork is fine. Otherwise, you have to go through the entire process again from the scratch, which may take around 60 days (working).
